Introduction & Effective Date

Effective Date: 01 November 2024

These Terms and Conditions ("Terms") represent a legally binding agreement between Airolus Aviation Academy Pvt. Ltd. ("the Academy") and any individual enrolling in its educational programs ("Student"). Where the Student is a minor or as required by the Academy, these Terms also bind their parent(s) or legal guardian(s) ("Guardian").

By submitting an application, making any fee payment, or commencing participation in any course offered by the Academy, the Student and their Guardian (if applicable) explicitly acknowledge, understand, and unconditionally agree to be bound by these Terms.

1. Admission and Enrollment

1.1. Eligibility Criteria

All applicants must strictly meet the specific eligibility criteria, including age, educational qualifications, and any medical fitness standards, as outlined by the Academy for their chosen course (e.g., Cabin Crew, Ground Operations). These criteria are subject to revision based on industry standards or regulatory mandates.

1.2. Admission Confirmation

Admission is provisional until the Academy receives the full course fee or the initial installment payment according to the agreed schedule, and all required documentation has been verified and found accurate. The Academy reserves the right to deny admission to any applicant without providing a specific reason.

1.3. Accuracy of Information

Students are solely responsible for providing truthful, accurate, and complete personal, educational, and medical information during the application and enrollment process. Submission of any false, misleading, or incomplete information will lead to immediate cancellation of admission without any refund of fees paid, and may result in legal action.

1.4. Student & Guardian Agreement

Upon admission, the Student and their Guardian (if applicable) are required to sign a separate "Student & Guardian Enrollment Agreement." This document will confirm that all information provided during counselling and admission is accurate, understood, and mutually agreed upon.

1.5. Acknowledgment of Eligibility
  • They have been fully informed of and comprehend all eligibility conditions prior to admission.
  • They understand that failure to meet or maintain these criteria may significantly impact the student's ability to complete the course successfully, receive certification, and secure job placement in specific aviation roles.
  • Should a Student proceed with enrollment despite not meeting or subsequently failing to meet eligibility requirements, this decision is deemed entirely independent and informed.
  • The Academy shall not be held liable for any limitations in job placement, denial of certification, or adverse outcomes resulting directly or indirectly from the Student's non-eligibility or misrepresentation of their eligibility status.
  • All responsibility for such a decision and its resulting consequences rests exclusively with the Student and their Guardian.

2. Course Fees and Payment Policy

2.1. Fee Structure

Detailed course fees, including installment plans, administrative charges, examination fees, and costs for study materials, are provided in the Admission Letter and Fee Schedule at enrollment. All fees are quoted in Indian Rupees (INR).

2.2. Payment Schedule

Course fees must be paid strictly according to the agreed-upon schedule. Delayed payments may incur late payment penalties, suspension of access to classes, study materials, and examinations, and may ultimately lead to termination of enrollment at the Academy's sole discretion, with no refund of fees paid.

2.3. Non-Refundable Fees

All course fees, once paid, are strictly non-refundable under any circumstances, except as specified in Clause 2.4. This includes, but is not limited to, situations where a Student:

  • Voluntarily withdraws from the course.
  • Is expelled due to disciplinary action.
  • Fails to meet attendance requirements.
  • Expresses dissatisfaction with the training.
  • Does not secure a job placement.

2.4. Academy-Initiated Course Cancellation

In the exceptional event that the Academy cancels an entire course before its commencement, a full refund of the course fees paid will be processed within 30 working days to the original payer. If the Academy cancels a course midway, a pro-rata refund for the unconsumed portion of the course will be provided. The Academy's decision on the refund amount shall be final and binding.

2.5. Additional Charges

Students acknowledge that additional charges may apply for specific activities, including familiarization trips, industry visits, specialized workshops, re-examination fees, duplicate certificates, or any other optional services. These charges will be communicated in advance.

2.6. Taxation

All fees are subject to applicable Goods and Services Tax (GST) or any other taxes levied by the Government of India, which may be revised from time to time.

3. Attendance, Punctuality, and Discipline

3.1. Mandatory Attendance

A minimum of 90% attendance for each module and overall is compulsory for a Student to qualify for certification and to be eligible for 100% job assistance. Students failing to meet this requirement may be debarred from assessments, certification, and job assistance, with no refunds issued.

3.2. Punctuality

Students must be punctual for all classes, practical sessions, workshops, and scheduled activities. Persistent unpunctuality may lead to disciplinary action.

3.3. Adherence to Rules

Students must at all times strictly adhere to all rules, regulations, policies, and guidelines issued by the Academy, including those related to conduct, decorum, use of facilities, and safety. These rules may be updated periodically, and students will be informed of such changes.

3.4. Grooming and Uniform

Students must strictly comply with the prescribed grooming, uniform, and professional behavior protocols as instructed by the Academy. This includes wearing the designated uniform during all academy hours, practical sessions, and official events. Consistent failure to meet these standards may affect eligibility for job assistance and may result in disciplinary action.

4. Course Structure, Training, and Assessments

4.1. Course Modification

The Academy reserves the absolute right to modify, update, or restructure course content, curriculum, training methodologies, daily schedules, class timings, and to assign or change instructors as deemed necessary to maintain quality standards, comply with industry advancements, or meet regulatory requirements, without prior notice.

4.2. Training Standards

Practical and theoretical training will be conducted in compliance with prevailing industry norms, safety standards, and best practices. The Academy strives to provide high-quality training facilities and resources.

4.3. Mandatory Participation

Students must actively participate in all theoretical classes, practical sessions, workshops, mock interviews, and assessments to successfully complete the course. Non-participation may result in failure to complete the course and obtain certification.

4.4. Internal and Final Assessments

Students are required to successfully clear all internal assessments, assignments, projects, and final evaluations conducted by the Academy. These assessments evaluate technical knowledge, communication skills, leadership potential, and overall job readiness. Failure to clear assessments may necessitate re-attempts, subject to additional fees and Academy policies, and may impact certification and placement assistance.

5. Certification and Job Assistance

5.1. Certification

Certification will be granted solely upon the successful completion of all course requirements, including clearing all assessments, fulfilling attendance criteria, adhering to the Code of Conduct, and full payment of all outstanding course fees and dues. The Academy reserves the right to withhold certification if any of these conditions are not met.

5.2. 100% Job Assistance Policy

Airolus Aviation Academy offers 100% Job Assistance upon successful course completion, strictly contingent upon the Student fulfilling the following conditions:

  • Maintaining a minimum of 90% attendance throughout the entire course duration.
  • Active and diligent participation in all training sessions, workshops, and extracurricular activities.
  • Successful clearance of all internal assessments and final evaluations conducted by the Academy.
  • Strict adherence to all academic, grooming, uniform, and professional behavior protocols as instructed by the Academy.
  • Compliance with the Academy's Code of Conduct and all other terms and conditions outlined herein.
  • Demonstrating a professional attitude, strong communication skills, and job readiness throughout the course.
  • Active cooperation with the placement team, including attending all scheduled interviews, workshops, and following guidance.
5.3. Job Guarantee Disclaimer

While the Academy provides 100% Job Assistance as outlined above, it explicitly states that job guarantees are NOT provided or implied. Placement assistance encompasses support in resume preparation, interview readiness, and opportunity referrals. The final hiring decision rests solely with third-party employers. Placement success is contingent upon the Student's individual performance, aptitude, suitability for roles, prevailing market conditions, and the specific hiring requirements of prospective employers. The Academy acts as a facilitator and does not guarantee employment.

5.4. Revocation of Job Assistance

Failure to meet any of the conditions stipulated in Clause 5.2 may result in the immediate and permanent revocation of Job Assistance privileges. In such cases, no claims for refunds, compensation, or alternative assistance will be entertained. The Student's own effort, commitment, and performance are equally essential for successful placement.

6. Code of Conduct

6.1. Professional Conduct

Students are expected to maintain the highest standards of professional conduct, integrity, and respect towards faculty, staff, fellow students, and Academy property at all times. This extends to all forms of interaction, including digital platforms.

6.2. Dress Code

Students must wear the prescribed uniform and maintain a professional appearance during all training hours, practical sessions, and official Academy events. Specific guidelines will be provided.

6.3. Prohibited Items & Activities

Mobile phones and other electronic gadgets are strictly prohibited during class hours and practical sessions unless expressly permitted by the instructor for academic purposes. Any form of distraction, including excessive talking or disruptive behavior, is forbidden. Smoking, consumption of alcohol, or use of any illicit substances within Academy premises is strictly prohibited and will lead to immediate expulsion.

Students shall not post defamatory, misleading, or disparaging content about the Academy, its faculty, or fellow students on any online or offline medium. Breach of this provision should allow the Academy to terminate enrolment without refund and pursue legal remedies under laws.

6.4. Misconduct

Any form of misconduct, including but not limited to ragging, harassment (sexual, verbal, physical, or psychological), bullying, discrimination, theft, vandalism, insubordination, cheating, plagiarism, defamation, or any other behavior deemed inappropriate or illegal by the Academy, will result in strict disciplinary action, including suspension, expulsion without refund, and potential legal prosecution. This includes inappropriate or disrespectful behavior on digital platforms such as WhatsApp groups, online sessions, and video calls.

6.5. Damage to Property

Students shall be held solely responsible for any damage caused to Academy property, equipment, or facilities, whether intentional or accidental, and shall be liable to compensate the Academy fully for such damage. The cost of repair or replacement will be borne by the responsible Student.

7. Health and Safety

7.1. Disclosure of Medical Conditions

Students must accurately disclose any pre-existing medical conditions, allergies, disabilities, or health concerns that may affect their ability to participate in the course or require special accommodation, at the time of admission. Failure to disclose relevant medical information may absolve the Academy of any liability.

7.2. Assumption of Risk

Participation in physical activities, practical training sessions (e.g., mock drills, emergency procedures), or any other activity involving physical exertion is undertaken at the Student’s own risk. While the Academy takes reasonable precautions to ensure safety, it shall not be liable for any injuries, accidents, or health issues arising from the Student's negligence, undisclosed medical conditions, or inherent risks associated with such activities.

7.3. Emergency Procedures

Students must familiarize themselves with and adhere to all health, safety, and emergency procedures established by the Academy, including fire exits, first aid locations, and evacuation plans.

8. Privacy Policy and Data Usage

8.1. Data Collection

The Academy collects and stores personal information, including, but not limited to, name, address, contact details, educational qualifications, medical information, photographs, and performance data for purposes of admission, enrollment, academic administration, assessment, certification, placement assistance, and compliance with legal and regulatory requirements.

8.2. Confidentiality

The Academy respects student privacy and implements reasonable measures to ensure the confidentiality and security of personal information collected. Personal data will be protected in accordance with applicable Indian data protection laws.

8.3. Data Usage and Promotional Consent

By enrolling, the Student explicitly consents to the Academy collecting, processing, storing, and using their personal data for:

  • Academic and administrative purposes.
  • Internal record-keeping and analysis.
  • Communication regarding courses, events, and important updates.
  • Facilitating placement assistance, including sharing relevant information with prospective employers.
  • Promotional activities, including the use of photographs, videos, or testimonials on digital and offline platforms. Students who do not consent to the use of their images/videos for promotional purposes must inform the Academy administration in writing before the course begins, clearly specifying the scope of non-consent.
  • Compliance with legal obligations and government regulations.
8.4. Third-Party Disclosure

The Academy may disclose necessary personal information to third parties, including government authorities, regulatory bodies, examination boards, industry partners, and potential employers, solely for purposes related to the Student's course, certification, or placement. The Academy will not sell or rent personal information to third parties for unrelated marketing purposes without explicit consent.

8.5. Privacy Policy Link

For a more detailed understanding of the Academy’s data handling practices, Students are encouraged to refer to the comprehensive Privacy Policy available on the Academy's official website.

9. Intellectual Property

9.1. Ownership

All course materials, teaching methodologies, software, presentations, assessments, logos, trademarks, and any other intellectual property developed by or belonging to Airolus Aviation Academy are and shall remain the exclusive property of the Academy.

9.2. Prohibition on Reproduction

Students are strictly prohibited from copying, reproducing, distributing, publishing, displaying, selling, or creating derivative works from any Academy intellectual property without the explicit prior written consent of the Academy.

9.3. Confidential Information

Students may be privy to confidential information related to the Academy's operations, business strategies, or proprietary training methods. Students are required to maintain strict confidentiality of such information and shall not disclose it to any third party during or after their enrollment.

10. Grievance Redressal and Dispute Resolution

10.1. Grievance Procedure

Any complaints, grievances, or disputes should be formally submitted by the Student in writing to the Academy's administration department. The written complaint must clearly state the nature of the grievance, relevant facts, and desired resolution.

10.2. Arbitration Clause

Any dispute or difference whatsoever arising between the parties out of or relating to the construction, meaning, scope, operation, or effect of this Agreement, or the validity or breach thereof, shall be settled by arbitration in accordance with the Rules and Procedure of the Delhi Arbitration Centre (“DAC”), Tis Hazari, Delhi.

In case of any dispute, a written application shall be made to the Registrar, DAC, and the award made in pursuance thereof shall be final and binding on the parties. The seat of arbitration shall be New Delhi, India, and the dispute shall be resolved by a sole arbitrator appointed in accordance with the Rules of DAC from the panel of arbitrators maintained by DAC.

Expedited Procedure: The parties agree that arbitration shall be conducted in an expedited manner under summary procedure rules, and the arbitrator shall make all reasonable efforts to render a final award within six (6) months from the date of the initial hearing.

Submission to Jurisdiction: For the limited purpose of seeking interim relief, including injunctions, or for enforcement of arbitral awards, the parties submit to the exclusive jurisdiction of the competent courts at New Delhi, India.

Survival: This arbitration clause shall survive the termination or expiration of this agreement and shall also apply to any subsequent agreements between the parties.

10.3. Ongoing Obligations

The initiation of arbitration shall not relieve the Student/(s) from complying with ongoing obligations under the Agreement, including attendance, discipline, and fee payment, unless expressly directed otherwise by the arbitrator.

10.4. Governing Law and Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the laws of India. Subject to the arbitration clause (Clause 10.3), the Courts in New Delhi shall have exclusive jurisdiction over any matter arising out of or relating to these Terms and Conditions.

11. Limitation of Liability

11.1.

The Academy shall not be liable for any loss, damage, injury, or death sustained by a Student, or for any loss or damage to a Student’s personal property, during or after their enrollment, unless directly caused by the Academy’s proven gross negligence or willful misconduct.

11.2.

In no event shall the Academy be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or in connection with these Terms or the Student's enrollment.

11.3.

The Academy’s total aggregate liability under these Terms, whether in contract, tort (including negligence), or otherwise, shall not exceed the total course fees paid by the Student for the specific course in question.

12. Force Majeure

12.1.

The Academy shall not be deemed in breach of these Terms or liable for any cessation, interruption, or delay in the performance of its obligations hereunder due to causes beyond its reasonable control, including but not limited to acts of God, war, terrorism, riots, insurrections, civil commotion, strikes, lockouts, epidemics, pandemics, government restrictions, natural disasters, or any other event of "Force Majeure." In such an event, the Academy shall endeavor to resume its operations as soon as reasonably practicable.

13. Amendments to Policies

13.1.

The Academy reserves the unequivocal right to amend, modify, or revise these Terms and Conditions, as well as any other policies, rules, or regulations, at any time, without prior notice, to adapt to changing legal requirements, industry standards, or operational necessities.

13.2.

Any amendments will be effective immediately upon being posted on the Academy's official notice board or website. While the Academy will endeavor to inform Students of significant changes, it is the Student's responsibility to periodically review the latest version of these Terms. Continued enrollment or participation in Academy activities after such amendments constitutes acceptance of the revised Terms.

14. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be severed from these Terms, and the remaining provisions shall continue in full force and effect.

15. Entire Agreement

15.1. These Terms and Conditions, together with the Admission Letter, Fee Schedule, and the Student & Guardian Enrollment Agreement, constitute the entire agreement between the Student (and their Guardian, if applicable) and Airolus Aviation Academy Pvt. Ltd. with respect to the subject matter hereof, and supersede all prior or contemporaneous communications, understandings, and agreements, whether oral or written.

BY ENROLLING AT AIROLUS AVIATION ACADEMY PVT. LTD., STUDENTS, AND WHERE APPLICABLE, THEIR PARENT(S) / LEGAL GUARDIAN(S), ACKNOWLEDGE THAT THEY HAVE READ, UNDERSTOOD, AND AGREED TO COMPLY WITH ALL THE AFOREMENTIONED TERMS AND CONDITIONS, ENSURING A PROFESSIONAL, DISCIPLINED, AND PRODUCTIVE TRAINING EXPERIENCE.
